Terms of Service

By creating an account or using the Service, you confirm you are at least 18 years old, have the legal authority to enter this agreement, and agree to these Terms and our Privacy Policy.

ezForge Platform provides managed hosting, monitoring, and discovery for Model Context Protocol (MCP) servers. We offer deployment infrastructure, OAuth 2.1 authorization services, and related tooling as described on our Pricing page.

You are responsible for maintaining the security of your account credentials. You must notify us immediately at legal@ezforge.ai if you suspect unauthorized access. We are not liable for losses arising from unauthorized use of your account.

You agree not to use the Service to:

• Violate any applicable law or regulation
• Transmit malware, spam, or unauthorized access tools
• Infringe the intellectual property rights of others
• Engage in activities that impose unreasonable load on our infrastructure (denial of service)
• Resell or sublicense the Service without written consent
• Process or store unlawfully obtained personal data

We reserve the right to suspend or terminate accounts that violate these restrictions without prior notice.

You retain ownership of all code, data, and content you deploy to the Service ("Your Content"). You grant us a limited, non-exclusive license to store, process, and serve Your Content solely as required to operate the Service.

You represent and warrant that you have all rights necessary to grant this license and that Your Content does not violate any third-party rights.

Paid plans are billed monthly in advance through our payment processor (Stripe). All fees are non-refundable except as required by law. We may change pricing with 30 days' notice. Continued use after the effective date constitutes acceptance of new pricing.

Accounts with overdue payments may be suspended after a 7-day grace period. Suspended accounts that remain unpaid for 30 days may be terminated and data deleted.

We target high availability but do not guarantee specific uptime for Free or Developer tier accounts. Pro tier accounts are subject to the uptime SLA stated on the Pricing page. Scheduled maintenance is excluded from SLA calculations.

The Service, including all software, documentation, and brand assets, is owned by ezForge AI, LLC and protected by applicable intellectual property laws. These Terms do not grant you any rights to our trademarks, logos, or proprietary technology beyond what is necessary to use the Service.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, EZFORGE AI, LLC AND ITS MEMBERS, OFFICERS, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM OR RELATED TO THESE TERMS SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS ($100).

You agree to indemnify and hold harmless ezForge AI, LLC from any claims, damages, or expenses arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.

Either party may terminate your account at any time. You may delete your account through the dashboard. We may terminate or suspend access for violations of these Terms, non-payment, or at our discretion with 30 days' notice (except for violations where immediate suspension is warranted).

Upon termination, your data will be retained for 30 days before deletion, during which you may export it.

These Terms are governed by the laws of the State of Michigan, United States, without regard to conflict of law principles. Any disputes shall be resolved by binding arbitration in Michigan in accordance with the American Arbitration Association rules, except that either party may seek injunctive relief in court.

We may update these Terms from time to time. We will provide at least 30 days' notice via email or in-product notification before material changes take effect. Continued use after the effective date constitutes acceptance.
